AC Hydraulic Inc. – Terms & Conditions

These Sales & Delivery Terms (“Terms”) govern all online purchases of AC Hydraulic spare parts (“Products”) from AC Hydraulic Inc. (“AC Hydraulic,” “we,” “us,” or “our”) through our website (“Site”). By placing an order, the customer (“Customer,” “you,” or “your”) agrees to these Terms.
1. Orders & Acceptance
1.1. All orders placed through the Site constitute an offer to purchase Products.
1.2. We reserve the right to accept or reject any order for any reason, including product availability, pricing errors, or incomplete customer information.
1.3. An order is considered accepted only when AC Hydraulic issues a written order confirmation or ships the Product.
2. Product Information & Fitment
2.1. AC Hydraulic makes reasonable efforts to ensure accurate product descriptions, compatibility information, and images; however, errors may occur.
2.2. It is the Customer’s responsibility to verify correct fitment for their intended application.
2.3. AC Hydraulic is not liable for labor costs, downtime, consequential damage, or improper installation associated with misordered or misapplied parts.
3. Pricing & Payment
3.1. All prices shown on the Site are in U.S. dollars (USD).
3.2. Prices may change without notice and do not include taxes, duties, or shipping charges.
3.3. The Customer authorizes AC Hydraulic to charge the full amount of the order—including applicable taxes and shipping—at the time the order is placed.
3.4. Sales tax is collected where legally required. Customers exempt from sales tax must provide valid documentation before purchase.
4. Shipping & Delivery
4.1. AC Hydraulic ships via major carriers (e.g., UPS, FedEx, USPS). Shipping costs are calculated at checkout.
4.2. Delivery times are estimates only and are not guaranteed.
4.3. Risk of loss transfers to the Customer when the Product is delivered to the carrier.
4.4. Orders containing backordered items may be shipped separately at AC Hydraulic’s discretion.
4.5. AC Hydraulic is not responsible for delays caused by carriers, customs, weather, or other events beyond our control.
5. International Orders
5.1. International Customers are responsible for all import duties, VAT, customs fees, brokerage charges, and compliance with local regulations.
5.2. AC Hydraulic is not responsible for shipments held, delayed, or refused by customs authorities.
6. Returns & Exchanges
6.1. Eligibility
- Returns must be requested within 30 days of delivery.
- Returned Products must be new, unused, uninstalled, and in original packaging.
- Electrical components, special-order items, tools, fluids, and closeout products are non-returnable.
6.2. Authorization Required
Customers must obtain a Return Merchandise Authorization (“RMA”) before returning any Product. Unauthorized returns may be rejected.
6.3. Refunds & Fees
- Approved returns may be subject to a restocking fee of up to 20%.
- Shipping charges are non-refundable.
- Customer is responsible for return shipping costs unless the return is due to AC Hydraulic’s error.
7. Warranty
7.1. AC Hydraulic Products may carry a manufacturer’s warranty, the terms of which vary by product type.
7.2. Warranty covers defects in material or workmanship but does not cover:
- misuse or abuse
- improper installation
- normal wear
- modifications or non-approved repairs
7.3. Warranty claims require proof of purchase and may require inspection of the Product.
7.4. AC Hydraulic’s liability under warranty is limited to repair, replacement, or refund at our discretion.
8. Limitation of Liability
To the fullest extent allowed by U.S. law:
- AC Hydraulic is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of revenue, labor costs, downtime, or equipment damage.
- Total liability for any claim shall not exceed the purchase price of the Product giving rise to the claim.
Certain states do not allow limitation of implied warranties or exclusion of consequential damages; in such cases, these limitations apply only to the extent permitted by law.
9. Cancellation
9.1. Orders cannot be canceled once processed for shipment.
9.2. Special-order or custom-made items cannot be canceled once the order is submitted.
10. Governing Law & Disputes
10.1. These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.
10.2. Any dispute shall be resolved exclusively in state or federal courts located in that state.
10.3. Customer agrees to personal jurisdiction in those courts.
11. Intellectual Property
All content, product data, images, and materials on the Site are the property of AC Hydraulic and may not be reproduced without written permission.
12. Changes to Terms
AC Hydraulic may update these Terms at any time. The version posted on the Site at the time of purchase governs that transaction.
